Welcome to FrontBrain AI. These Terms of Service (“Terms”) govern your access to and use of the FrontBrain AI website, platform, application, API, and associated services (collectively, the “Service” or “Platform”) provided by FrontBrain AI LTD (“we,” “us,” or “our”).
By registering for an account, purchasing a subscription, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
1. The FrontBrain AI Platform
FrontBrain AI is an autonomous AI operations and workflow automation platform. The Service allows users to plan, execute, verify, and coordinate complex tasks across software development, DevOps, IT operations, coding, website/app building, documentation, server administration, and technical workflow automation. The platform relies on advanced artificial intelligence models to orchestrate activities across user-connected systems.
2. User Responsibilities & AI Execution
As a user of FrontBrain AI, you acknowledge and agree that:
- Prompts and Inputs: You are solely responsible for all instructions, prompts, code, configurations, and data you submit to the Service.
- Outputs and Actions: AI-generated outputs, including code, scripts, configurations, and server commands, are suggestions and may contain errors. You are solely responsible for reviewing, testing, and verifying all outputs before applying or executing them.
- Server Actions and Deployments: You are solely responsible for all actions taken on your servers, databases, cloud instances, and connected systems (including cloud, servers, databases, hypervisors, firewalls, storage, backup, identity, security, DevOps, SaaS, and hardware management connectors) initiated through FrontBrain AI, whether the execution is performed cloud-side or via the FrontBrain AI Remote Gateway installed inside your network.
- Remote Gateway operation: If you choose to install the Remote Gateway, you are responsible for the host machine, its operating-system patching, the
policy.yaml file enforcing tool / egress / workspace restrictions, and the security of credentials that you elect to keep under Local credential mode. FrontBrain AI is responsible for the gateway agent code, the cloud-side control plane, and the documented behaviour of dispatched tool calls.
- Verification: You must actively review and verify any actions planned or proposed by the AI, particularly those requiring explicit human confirmation.
3. Usage Credits & Subscriptions
FrontBrain AI operates on a subscription model that includes usage credits:
- Credit Consumption: AI-powered tasks, research, code execution, and operations consume credits based on the complexity, model tier, and compute resources utilized.
- Digital Consumption: Credits represent digital usage and are consumed immediately upon execution of a task.
- No Guarantee of Outcome: Credits are consumed by the attempt and execution of a task, and do not guarantee a specific successful outcome due to the non-deterministic nature of AI models and external system states.
- Credit Overrun: FrontBrain AI may, at its discretion, allow an already-running task that started with available credits to continue beyond the user’s remaining credit balance within a controlled overrun allowance. Overrun usage is billable usage and creates an obligation to repay or replenish the equivalent credits. FrontBrain AI may recover overrun credits from the user’s next subscription renewal, top-up, credit grant, manual credit allocation, or other account credit event before making new credits available.
- Recovery of Unpaid Overrun Usage: If overrun credits remain unpaid, unrecovered, or otherwise outstanding, FrontBrain AI reserves the right to restrict, suspend, or limit further access to paid features until the overrun balance is resolved. FrontBrain AI also reserves the right to recover the value of unpaid overrun usage, together with any reasonable costs incurred in recovering that amount, including administrative, payment processing, legal, collection, or enforcement costs, to the extent permitted by applicable law. The user is responsible for such recovery costs where the unpaid overrun balance is caused by non-payment, failed payment, chargeback, cancellation, or failure to maintain sufficient payment or credit balance.
- Overrun Limitations: Overrun is not a guarantee that every task will continue indefinitely or complete successfully. FrontBrain AI may limit or refuse overrun based on account status, plan limits, abuse prevention, risk controls, failed payments, excessive usage, or other operational reasons.
- BYOK: If you connect supported third-party API keys, some model usage may be routed through those keys and billed directly by the third-party provider. BYOK-routed usage does not consume FrontBrain AI credits for those routed calls, but you remain responsible for all charges, limits, usage, and terms imposed by the third-party provider.
- Credits: Credits and top-ups are usage units, not stored monetary value, banked funds, or refundable cash balances unless required by law or expressly stated by FrontBrain AI.
- Gateway-routed execution: Tool calls executed through the FrontBrain AI Remote Gateway consume the same credit amounts as cloud-routed tool calls. The fact that execution happens inside your network does not change the credit accounting. FrontBrain AI reserves the right to introduce differentiated pricing for gateway-routed calls in the future, with prior public notice.
4. Acceptable Use & Restrictions
You agree not to use the Service, or permit others to use the Service, to:
- Engage in any illegal, harmful, abusive, fraudulent, or unauthorized activity.
- Attempt to gain unauthorized access to any servers, networks, systems, or accounts.
- Deploy malware, viruses, or any other harmful software, or perform unauthorized security penetration testing.
- Infringe upon the intellectual property rights of others.
- Abuse, spam, or overload the Service infrastructure or API limits.
We reserve the right to suspend or terminate your account immediately, without notice, if we suspect any violation of these acceptable use policies.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INNOVATIVE TECHNOLOGY CONSULTING LTD, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OF OR INABILITY TO USE THE SERVICE.
- ANY ACTIONS OR DEPLOYMENTS APPLIED TO YOUR CONNECTED INFRASTRUCTURE, SERVERS, OR DATABASES.
- ANY ERRORS, INACCURACIES, OR INCOMPLETENESS IN AI-GENERATED OUTPUTS, CODE, OR CONFIGURATIONS.
- UNAUTHORIZED ACCESS, ALTERATION, OR LOSS OF YOUR TRANSMISSIONS, CREDENTIALS, OR DATA.
OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
6. Account Suspension & Termination
We reserve the right to suspend, restrict, or terminate your access to the Service at our sole discretion, without liability, for reasons including but not limited to: non-payment of subscription fees, credit card/chargeback abuse, suspected system abuse, security risks, or violations of these Terms.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of England and Wales, and you and FrontBrain AI LTD each irrevocably submit to their exclusive jurisdiction. Nothing in this clause limits any statutory right that cannot be excluded under UK consumer law.
8. Changes to Terms
We may modify these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after such changes constitute your acceptance of the new Terms.
